Environmental Law

The Legal Accord provides legal advice and representation on environmental compliance, regulatory approvals, pollution-control obligations, environmental assessments and disputes involving environmental authorities.

We assist businesses, developers, industrial units, institutions and individuals in navigating Pakistan’s federal and provincial environmental framework, with particular attention to compliance, project approvals and enforcement risk.

Overview:

Environmental law in Pakistan operates through a combination of federal and provincial legislation. In Punjab, the principal framework includes the Punjab Environmental Protection Act, 1997, as amended, together with rules and regulations issued by the Environment Protection Department.

For development and industrial projects, environmental approval requirements may include an Initial Environmental Examination (IEE) or Environmental Impact Assessment (EIA), depending on the nature, scale and location of the project. Punjab’s current framework also includes the Review of IEE/EIA Regulations, 2022 and other sector-specific environmental rules.

Our Approach to Environmental Matters

At The Legal Accord, we begin by identifying the client’s activity, project type, location, applicable regulator and required approvals.

We review whether an IEE, EIA, environmental approval, licence, consent or other regulatory requirement is applicable, and advise on compliance before a project is commenced or expanded.

Where a client is facing enforcement action, environmental notices, penalties or litigation, we assess the statutory basis of the action and develop an appropriate response before the relevant authority, tribunal or court.

IEE, EIA & Environmental Approvals

Environmental assessment is a key requirement for many development and industrial projects.

Under Punjab’s environmental framework, projects that may affect the physical environment can be required to obtain environmental approval before construction or operation, with the appropriate assessment depending on the category of the project. The Punjab Environment Protection Department currently lists the Review of IEE/EIA Regulations, 2022 among its applicable regulations.

The Legal Accord assists clients in understanding the legal requirements applicable to their projects and in addressing regulatory issues arising during the environmental approval process.

Pollution Control & Regulatory Compliance

Environmental obligations extend beyond project approval and may continue throughout the operation of a business or industrial facility.

Relevant requirements can involve emissions, effluent, waste disposal, noise, hazardous substances and compliance with applicable environmental standards. Punjab’s regulatory framework currently includes rules dealing with areas such as smog prevention, single-use plastics, environmental penalties and environmental tribunals.

We advise clients on identifying compliance risks, responding to regulatory inspections and notices, and taking corrective action where necessary.

Environmental Enforcement & Litigation

Environmental authorities may initiate enforcement proceedings where they consider that an activity is being conducted contrary to applicable environmental law or approval conditions.

The Legal Accord represents clients in matters involving environmental notices, administrative action, penalties, environmental tribunal proceedings and related constitutional or judicial review proceedings.

We also advise clients on preventive compliance measures aimed at reducing the risk of enforcement and operational disruption.

Environmental Due Diligence & Business Advisory

Environmental liabilities can affect acquisitions, property development, industrial operations and investment decisions.

We assist businesses with environmental legal due diligence, including review of approvals, compliance history, environmental obligations and potential regulatory exposure.

This allows clients to evaluate environmental risk before entering transactions, acquiring assets or commencing major projects.
